Welcome to ComLeads ("we", "us", "our"). By accessing or using our Telegram bot, services, or data (collectively, the "Service"), you ("User", "you", "your") agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use our Service.

1. Description of Service (Data Aggregator)

ComLeads is a B2B data aggregation platform that monitors public government databases (such as building permits) and utilizes third-party APIs and Artificial Intelligence (LLMs) to enrich and classify this data for business-to-business (B2B) networking purposes.

2. No Consent & TCPA/CAN-SPAM Liability

2.1 No Marketing Consent Provided: We provide enriched data for B2B informational purposes only. We DO NOT obtain, guarantee, or transfer any consumer "opt-in" consent for marketing communications, robocalls, SMS, or emails.

2.2 User Responsibility: You are solely responsible for ensuring that your use of the data complies with all applicable local, state, and federal laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and the Telemarketing Sales Rule (TSR). You agree to independently cross-reference all phone numbers against the National Do Not Call (DNC) Registry and state-level registries before initiating any outreach.

2.3 Indemnification: You agree to indemnify, defend, and hold harmless ComLeads and its affiliates from any claims, lawsuits, fines, or damages (including attorney's fees) arising from your outreach activities, telemarketing, or violation of any privacy laws.

3. Privacy Laws (CCPA & State Regulations)

3.1 B2B Use Only: The data provided is strictly for establishing commercial relationships (B2B). Any use of this data for consumer (B2C) marketing is strictly prohibited.

3.2 Opt-out & Deletion: You agree to honor all opt-out and deletion requests from data subjects immediately and remove their information from your CRMs and communication sequences in accordance with the California Consumer Privacy Act (CCPA) and other state privacy laws.

4. Fair Credit Reporting Act (FCRA) Disclaimer

ComLeads is NOT a "Consumer Reporting Agency" as defined by the Fair Credit Reporting Act (FCRA). You are strictly prohibited from using our data, in whole or in part, as a factor in determining a consumer's eligibility for credit, insurance, employment (Employment Screening), housing (Tenant Screening), or any other purpose regulated by the FCRA.

5. AI Processing & "As Is" Warranty

5.1 AI Hallucinations: Our Service utilizes Artificial Intelligence (AI) to parse, classify, and enrich unstructured public records. While we strive for accuracy, AI systems may generate errors, misclassify niches, or estimate budgets inaccurately.

5.2 AS-IS Basis: The Service and all data are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or timeliness of the information provided. You assume all risks associated with the use of the data.

6. Intellectual Property & Anti-Scraping

6.1 Limited License: We grant you a limited, non-exclusive, non-transferable license to use the data internally within your company for legitimate B2B sales and outreach.

6.2 Prohibited Actions: You may not copy, resell, redistribute, publicly display, or create derivative works from our data. Automated data collection (scraping, crawling) from our Telegram bot or APIs is strictly prohibited.

6.3 Shadowban Policy: Violation of these terms will result in immediate termination of your access without notice (including silent bans or "shadowbans") and potential legal action.

7. Billing, Trials, & Refund Policy

7.1 Subscriptions: By subscribing to a paid plan, you authorize our payment processor (LemonSqueezy) to charge your payment method on a recurring basis.

7.2 Trials & Abuse: Free trials (if applicable) are strictly limited to one per user/business entity. Attempting to bypass trial limits by creating multiple accounts constitutes fraud and will result in immediate termination.

7.3 All Sales Are Final: Due to the nature of digital data services and hard costs associated with API enrichments, we do not offer refunds for any current or past billing cycles. You may cancel your subscription at any time, and you will retain access until the end of your current paid billing period. No pro-rated refunds are provided.
